If you're reading our Express Terms & Conditions you are either very inquisitive, are here to pinch our exquisitely written words (do us a favour, credit us if you do), or genuinely have a problem...or you could be one of the few people who reads terms and conditions before buying, which is something you should always do, so bravo to you if that's why you're here!
 
Everything you see on this page is guided by the UK Government's rules and regulations on selling. You see, we abide by rules and regulations not only because we have to, but because we want to - it makes us feel better and we'd like to think it makes you feel confident in us by showing we are a transparent company with nothing to hide!
 
OK, enough about that, here's what you really want to know:
 
 
THE CONSUMER CONTRACTS (INFORMATION, CANCELLATION AND ADDITIONAL CHARGES) REGULATIONS 2013
 
All OSATO® store policies are compliant with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
 
These are the rules that apply when we sell products or services to you, our customer, without face-to-face contact. This happens when you have not had an opportunity to examine the goods, or discuss the service, in person before buying.
 
This includes selling products to you online, through digital TV, by mail order or by phone, text message or fax (we don't even have a fax machine, but we have to state this regardless!).
 
Let's be clear people, compliance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 is a legal requirement in the UK. There's no getting around it - quite simply, our advice is to trust companies like us who are only too happy to abide by these codes and tell you about it.
 
At times, we may have pop-up stores which usually entails exhibiting at an event or show somewhere around the UK, or even in other countries. When this happens, and you buy from us on that day, you are bound by standard store policies related to those type of stores.
 
 
1. PURCHASES
 
If you bid on or purchase any items on eBay, please ensure you have read and understood all of our terms and conditions. All items are sold AS-IS, so please ensure you look at any images carefully and read the listing details thoroughly before bidding or purchasing.
 
All of our auctions and fixed price listings are covered by the eBay bidding terms where every bid and purchase is binding.
 
Where a "Buy It Now" option is not offered, auctions will run to their end and no "Buy It Now" offers will be entertained.
 
If you are unsure and need further information, please ask in a timely manner and before the end of your viewed listing.
 
1a. PROOF OF PURCHASE
 
Whilst we hold files on all sales, in any event pertaining to your purchase you must provide proof that you bought an item from OSATO, otherwise we would have every Tom, Dick and Harry writing to us (sorry if one of those is your actual name)!
 
Proof could be in the form of a sales receipt or other evidence such as a bank statement or packaging with your name on, which we will then cross-reference against our records.
 
If you cannot provide proof of purchase then we cannot help you, but in today's world you will have a copy sent to your email address on order confirmation so whatever you do, don't delete it!
 
1b. GRADING SYSTEMS
 
Posters, Lithographs, Prints and Related Items:
 
1. Very Fine: Little to no visible, distracting defects.
2. Fine: Minor defects to border/mount area and edges. Artwork free from noticeable blemishes.
3. Excellent: Some blemishes in border and artwork with minor fading, holes and/or tears.
4. Good: Noticeable blemishes within border and artwork with tears, holes and/or pieces missing.
5. Fair: Major blemishes throughout. Candidate for conservation and restoration.
6. Poor: Serious blemishes in which handling may add to damage. Candidate for conservation and restoration.
 
Toys, Games and Related Items:
 
1. Mint: Item is in perfect condition.
2. Near Mint: Extremely minor imperfections; almost perfect
3. Excellent: Small imperfections exhibiting very careful use.
4. Good: Average use with noticeable imperfections.
5. Fair: Major imperfections including possible restoration with heavy use.
6. Poor: Serious imperfections, suitable for spares and repairs or restoration.
 
1c. ORDER ACCEPTANCE
 
You have accepted an order if you have told us you have accepted it, having had enough opportunity to inspect the item before confirming you have received it.
 
Your acceptance is confirmed the day you receive your order through delivery confirmation or by signing for it and after the first 30 days from receiving the order.
 
 
2. Returns & Refunds
 
We are very sorry if you are reading this because you wish to return part or all of your order. This makes us disappointed. We are extremely customer service focused and pride ourselves on making sure you have the best experience possible.
 
2a. UK Returns & Refunds (excluding business to business (B2B) sales)
 
i) In the unlikely event you are not happy with your purchase, you can state your intention to return your order within 30 calendar days of delivery
ii) You have another 14 calendar days to return the goods once you have informed us
iii) We will then refund you within 14 calendar days of receiving the goods back
 
If you choose a non-standard delivery method when you order, we are legally bound to refund you only the cost of the standard rate.
 
Please do not return anything without contacting us in writing - in accordance with The Consumer Contracts Regulations 2013, a clear statement of cancellation is required from you.
 
2b. EU Returns & Refunds
 
ON 23 JUNE 2016, THE UNITED KINGDOM VOTED TO LEAVE THE EUROPEAN UNION. AS A BRITISH BUSINESS WHO BELIEVES IN DEMOCRACY AND THE FREEDOM OF EVERY NATION AROUND THE WORLD, WE WELCOMED THIS RESULT.
 
AS A RESULT, FROM 31 JANUARY 2020, THE UK WILL NO LONGER BE A MEMBER OF THE EUROPEAN UNION. IF OR WHEN A TRADE AGREEMENT IS COMPLETED BETWEEN THE UNITED KINGDOM AND EUROPEAN UNION, WE CAN THEN LOOK INTO THE POSSIBILITY OF ONCE AGAIN OFFERING RETURNS AND REFUNDS TO BUYERS FROM THE EUROPEAN UNION IN SELECT CASES ONLY.
 
2c. Non-UK (International, including European Countries) Returns & Refunds
 
We will not usually accept international returns unless the item is genuinely not as described (we describe all our items correctly so please ensure you read our grading and condition information before ordering).
 
However, if you have a problem please contact us by email to discuss any issue you may have with your purchase.
 
2d. B2B Returns & Refunds
 
B2B sales are exempt from the The Consumer Contracts (Information, Cancellation and Additional) Charges Regulations 2013, therefore, return and refund requests will not be accepted unless part or all of the order is genuinely not as described (we describe all our items correctly so please ensure you read our grading and condition information before ordering).
 
B2B sales includes any buyer who purchases an item from us with the intention of selling on for additional profit. If you buy as a consumer and we find out at a later date you were in fact buying for business purposes, we have the right to change the terms of service to B2B. An example would be if you bought an item as a private buyer and then that item appeared on your own website or sales platform such as eBay or any other for an increased financial amount resulting in additional profit made from your original purchase from us.
 
2e. Sales
 
UK ONLY - You have exactly the same rights to a refund when you buy items in a sale as when you buy them at full price. If a business says you don't, they're telling you a few porkies!
 
2g. Conditions of Return - Shipping
 
Buyers are responsible for return shipping costs via the same method the original order was posted. For instance, if your order was sent by Royal Mail Signed For, you will need to post it back to us the same way and NOT by standard Royal Mail postage. If an item was sent by Royal Mail Special Delivery, you will need to post it back to us the same way and NOT by Royal Mail Signed For or standard postage.
 
If you return an item UNDER-INSURED, and the said item is damaged in transit, we reserve the right to withhold any monies from you due to such losses that cannot be claimed back via the courier.
 
2h. Conditions of Return - Goods
 
If an item is not returned in its original condition, the buyer is responsible for any loss in value. You have a duty of care to ensure goods are kept in the same condition they were sent to you. The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 allows us to make a deduction from the reimbursement for loss of value of any goods supplied, if the loss is the result of unnecessary handling by you.
 
You must handle the product no more than you might in a shop.
 
2i. Repairs & Replacements
 
If you have accepted an item, but later discover a proven fault the following applies:
 
i) Within 30 days of purchase, you are allowed a refund
ii) After 30 days and within six months of purchase, you have a right of repair and replacement. If the purchased item cannot be proven to be faulty at the point of purchase we will not offer a repair or replacement, or refund in the event an item has been discontinued or has sold out
 
 
3. WHEN WE DON'T HAVE TO OFFER A REFUND, REPAIR OR EXCHANGE
 
Did you know there are occasions when we don’t have to offer a refund? You may be surprised by the amount of people who don't know that (or conveniently forget!), which is why we are very happy to tell you about them here.
 
We have a legal right not to offer a refund, repair or replacement when:
 
i) You knew an item was faulty or damaged when you bought it (any faults or damage will be stated in the item description); for example, warehoused or second hand goods such as original movie memorabilia that may contain imperfections.
ii) You damaged an item by trying to repair it yourself or getting someone else to do it.
iii) The order is being returned by someone other than you (the original buyer).
iv) Unless proven to be faulty - personalised and custom-made items, perishable items (eg food or flowers), unwrapped CDs, DVDs, digital content and software.
 
 
4. WARRANTIES & GUARANTEES
 
If a warranty is provided on an item we sell it is done so by the manufacturer of the item and not by Osato, and so all relevant information will be provided with the said item.
 
4a. LIFETIME GUARANTEE (APPLICABLE PRODUCTS)
 
Let's face it, you see these guarantees thrown around quite often. What sets us apart is that it is our promise to you that the applicable products we sell are what they are, and nothing else. Put it this way, if we do not believe an applicable item is what it is then we will not sell it. It's as simple as that.
 
It is important to note that the lifetime guarantee is not the same as a right to a refund, repair or exchange - we are not giving you a lifetime period to decide whether or not you want to return an item (that would just be silly on any business level). What we are doing is providing you lifetime confidence in the products we sell.
 
 
5. PAYMENT
 
All payments to be completed in GB Pound Sterling. No exceptions, not even if one of us is travelling to your country in the next week or two and you want to pay us in person.
 
5a. PAYMENT METHODS
 
Payment to be completed in GB Pound Sterling via one of the following methods:
 
i) Stripe (our preferred, safe payment gateway) where you can pay over the phone and in person using your debit or credit card. Please contact us after purchase to pay via Stripe
ii) PayPal
iii) Personal Cheque / Postal Order (you must contact us prior listing end)
iv) Bank Transfer (you must contact us prior listing end)
v) Cash (you must contact us prior listing end)

Any payments made by direct bank transfer must be started no later than 23:59 GMT on the fifth (5th) working day after date of order confirmation unless otherwise agreed prior purchase.

If sending payment through the post we recommend using a registered method, such as Royal Mail Special Delivery Guaranteed or Royal Mail Signed For in the UK. We cannot be held responsible for any loss incurred in transit and if we don't receive payment we cannot process your order.
 
5b. FIXED PRICE LISTINGS (WHEN ORDERING ONE ITEM)
 
i) Payment to be made immediately following purchase. We may provide you a grace period of up to 24 hours at our sole discretion
ii) Failure to pay will result in a non-paying buyer case being started in accordance with eBay regulations
 
5c. AUCTION LISTINGS (WHEN ORDERING ONE ITEM)
 
i) Payment to be made in no less than five working days from end of auction, unless otherwise agreed prior auction end
ii) Failure to pay within this timeframe will result in a non-paying buyer case being started in accordance with eBay regulations
 
5d. FIXED PRICE & AUCTION LISTINGS (WHEN ORDERING TWO OR MORE ITEMS)
 
i) If you purchased two or more items, you may pay the automatically provided costs. Any overpayment of shipping fees, if applicable, will be refunded (because we're nice like that!)
ii) If, however, you wish to wait for the exact charges before payment, please do NOT pay until we have sent you an invoice detailing the TOTAL and CORRECT charges - you must ask us for an updated invoice
iii) Payment to be made in no less than five working days after invoice has been sent
iv) We will combine postage and packaging when and where possible in order to save you money
 
If you have underpaid, your items will not be dispatched until total payment has been received and cleared in full.
 
OSATO reserves the right to cancel any order if payment has not been processed within the stated timeframe or for any other reason under our sole discretion.
 
 
6. POSTAGE & PACKAGING
 
All orders are dispatched insured with delivery confirmation and may require a signature on delivery - after all, we want to make sure you actually receive your purchase. We will never send an order if it cannot be tracked.
 
i) Your order will be dispatched within two working days of order confirmation and cleared payment
ii) It will take a further two to three working days to arrive once it has been posted, unless your order has been sent by Next Day delivery. Non-UK orders will take approximately five to eight working days to arrive
iii) We aim to dispatch orders same day but sometimes it is simply not possible. Of course, there are also times when due to the size of the order shipping can take longer than expected
iv) We will notify you if any item cannot be shipped within the stated time-frame
 
You may also collect your purchase at your own convenience - please contact us to make arrangements.
On collection you must view your order before taking possession of it. If you are happy, we will both sign a sales receipt confirming your acceptance and agreement of the order and of its condition.
 
We cannot group two distinct orders placed separately, so shipping fees will apply to each distinct order.
 
Items ordered together are also not necessarily shipped together and may incur additional fees. For example, an order consisting two items requiring cylindrical tube packaging (for a large poster) and an envelope or small box (for a book) will be sent separately.
 
Your package will be dispatched at your own risk and we cannot be held responsible for any damage occurred in transit.
 
We cannot be held responsible for late delivery once your order has been dispatched, particularly for non-UK orders that have been accepted into a given country as customs have been known to hold onto items for several weeks.
 
If you have any questions, there is a problem with your order or it has not arrived within the given time-frame (non-UK orders must allow a minimum 25 working days), please contact us first so we can contact the postal courier on your behalf.
 
6a. POSTAGE
 
Postage is charged at cost (unless where free delivery is offered), must be paid for by you and is determined by the item weight, size and value.
 
No profit whatsoever is made on postage.
 
6b. UK POSTAGE GUIDE
 
We only send items insured with delivery confirmation which may include a signature for the protection of you and your order.
 
i) Item value up to £20.00 - Royal Mail 2nd Class Standard
ii) Item value up to £50.00 - Royal Mail 2nd Class Signed For
iii) Item value £50.00 to £500.00 - Royal Mail Special Delivery
iv) Item value £500.00 to £2500.00 - Royal Mail Special Delivery
v) Item value over £2500.00 - specialist courier.
 
We may use other couriers for your benefit, particularly for items valued over £2500.00.
 
6c. UK PARCEL SIZE GUIDE:
 
The following is based on parcels dispatched through Royal Mail. Other postal services may provide different size guidelines.
 
i) Large Letter - Boxes or envelopes that measure as follows, allowing space for packaging at all sides: Max length: 35.3cm / Max width: 25cm / Max thickness: 2.5cm / Max weight: 750g.
ii) Small Parcels - Boxes or tubes that measure as follows, allowing space for packaging at all sides: Max length: 45cm / Max width: 35cm / Max thickness: 16cm / Max weight: 2kg.
iii.1) Medium Parcels - Boxes that measure as follows, allowing space for packaging at all sides: Max length: 61cm / Max width: 46cm / Max thickness: 46cm / Max weight: 20kg.
iii.2) Medium Parcels - Tubes (for posters/prints longer than 40cm on their shortest side) that measure as follows, allowing space for packaging at all sides: Max dimensions: Length + twice the diameter must be 104cm or less / Max length: 90cm.
 
6d. NON-UK POSTAGE GUIDE
 
We only send items insured with delivery confirmation which may include a signature for the protection of you and your order. We will either use Royal Mail or other couriers for your benefit.
 
6e. NON-UK PARCEL SIZE GUIDE:
 
The following is based on parcels dispatched through Royal Mail. Other postal services may provide different size guidelines.

6f. PACKAGING
 
When P&P is payable, we add a small charge of between £1.50-5.00 for every package (which is more than reasonable) to cover actual costs of the materials used, our time packing your order and posting it.
 
The exact charge can be found by subtracting the relevant postage cost from the total P&P fee quoted. Please refer to the Royal Mail Price Guide or ask us if you want to know - we are 100% transparent.
 
Please remember that most of the items sold by Osato are not simply off-the-shelf products that require very little time and effort in packaging. Therefore, we kindly ask you to take into account how long it takes to pack an order and how carefully items must be handled.
 
For the same type of item (eg a film poster) it takes an equal amount of time to package one of a £10.00 value as it does a £500.00 value.
 
No profit whatsoever is made on the packaging service.
 
6g. COMBINED POSTAGE & PACKAGING
 
We will combine postage and packaging when and where possible on auction AND fixed price items. Partial refunds will be given in these circumstances.
 
 
7. WORKING DAYS
 
You wouldn't believe (or maybe you do) how many people class weekends and national holidays as working days.
 
i) A working day consists of any day from Monday through Friday.
ii) A Saturday and Sunday is not a working day.
iii) UK National Bank Holidays are also not working days.
 
 
8. BUYER BEHAVIOUR
 
We reserve the right to ban any member from bidding on any of our listings who we feel breaches eBay rules and/or breaches our terms and conditions.
 
Any fraudulent activity will not be tolerated and will be dealt with accordingly first through eBay, second through the payment processor and then through the UK law courts if necessary.
 
 
9. LIMITATION OF LIABILITY
 
In no event will Osato be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of access to, or the use of, this my listings or any information contained in them, including loss of profit and the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages.
 
Nothing on this page shall exclude or limit our liability for death or personal injury caused by negligence or for fraudulent misrepresentation.
 
 
10. DISCLAIMER OF WARRANTY
 
To the maximum extent permitted by law, Osato disclaims all implied warranties with regard to the information, services and materials contained in our listings when and where applicable; all such information, services and materials are provided "as is" and "as available" without warranty of any kind.
 
 
11. INDEMNIFICATION
 
You agree to indemnify, defend and hold OSATO harmless from any liability, loss, claim and expense (including reasonable legal fees) related to your breach of these terms and conditions.
 
Your use of our listings, any downloaded material from them and the operation of these terms and conditions shall be governed by, construed and interpreted in accordance with UK laws and you agree to submit to the non-exclusive jurisdiction of the UK courts.
 
 
All of our items are advertised elsewhere, including on our website OSATO.co.uk, and so may be withdrawn at any time.
