Please read these terms and conditions in full before making a purchase. All purchases are governed
by these terms and conditions. Throughout the site the terms “we”, “us” and “our” refer to Smelliz
LTD. By making a purchase you agree to be bound by these terms and conditions.
The titles within this agreement are for convenience only and will in no way limit or affect the terms
within.
Accuracy of Information.
We take all reasonable steps to ensure that our information is up to date and accurate. However, the
material on this site is for general information only and we cannot guarantee it to be error free.
Reliance on this material is at your own risk and is provided without any warranty of any kind.
We reserve the right to modify the content on this site at any time and you agree it is your
responsibility to monitor any change to the site.
Products.
Whilst we make every reasonable effort to ensure the accuracy of our product images, we cannot
guarantee your computer colour display will be accurate or in line with our own. Furthermore, as all
of our items are 100% handmade, there will always be small variations within each design.
Product prices and descriptions are subject to change at our sole discretion without any notice. We
reserve the right to discontinue products or services at any time. We will not be held liable for any
loss to you or any third party as a result of any price change, item modification or product/service
withdrawal.
We hold no guarantee that the quality of our product or services will meet your expectations.
Orders.
We reserve the right to reject any order you place with us. We may at times limit the quantity of
items per person or per household.
We accept no liability for any inaccuracies or errors on the website. We reserve the right to correct
any errors or omissions without prior notice, including after an order has been submitted, if the
information was inaccurate at any time.
We accept no liability for the cancellation of orders. We may cancel your order if;
(a) An item you ordered is out of stock
(b) We identify a product or pricing error
(c) We are unable to process your payment.
We will not be liable for any delay in delivery if your payment method is rejected. In the event of any
of the above, we will contact you using the details you provided when placing the order.
Delivery.
Delivery times are indicative only. In line with our delivery policy, we will aim to dispatch your order
within two working days but will not be held liable if this is not possible for any reason. We accept no
liability for delays in delivery caused by a third party.
Cancellation and Returns.
Under Consumer Contract Regulations you have the right to cancel your order within 14 days from
the date you receive your order. Due to hygiene reasons, we are unable to accept returns on our
cosmetic products if the product packaging has been opened. We do not accept the return of
personalised goods, unless faulty.
To begin the cancellation procedure, please contact us before the cancellation period has ended. We
will not accept any cancellations after the 14 day cancellation period.
Whilst in possession of the goods they remain your responsibility and you must take reasonable care
of them. You must return the goods, at your own cost (unless previously agreed by us) before we will
issue a refund.
If there are any discrepancies with your order, or in the unlikely event your orders arrives damaged,
please contact us within 14 days.
General.
We reserve the right to change or update these terms at any time. It is your responsibility to check
these terms for any changes or updates before each purchase. The last update to these terms was
05.10.2020.
If any provision of these terms and conditions are deemed to be unlawful, invalid or unenforceable,
such provision shall be enforceable to the fullest extent of the applicable law. The remaining terms
and conditions shall continue to be valid and the unenforceable portion shall not affect the validity
and enforceability of the remaining provisions.
You agree that these terms and conditions, along with the privacy policy, constitute the entire
agreement between you and us, regarding the use of our website, services and the purchase or use
of our products. These terms supersede any prior agreement, communications or proposal, whether
oral or written, and any previous version of these terms and conditions.
Any failure by us to exercise or enforce any of these terms and conditions shall be in no way
construed to be a waiver of any of the terms or conditions outlined in this agreement.
We grant you permission to use our information for your own private purposes only and in
accordance with these terms and conditions.
You must not modify or reproduce our content without our written consent.
You agree not to violate or infringe upon our intellectual property rights or of those affiliated
with Smelliz LTD. You agree you will not use any aspect of our service or products for any unlawful or
unauthorised reason.
